That said, there are some important legal hoops to jump through – especially when it comes to bringing your new tiny human back to your home country.
Here’s what you need to know (without the legalese headache).
1. Know What You’re Dealing With: Two Countries, Two Sets of Rules
Even though your baby is being born in the U.S., your home country is going to want some paperwork before letting you hop on a plane with your newborn. So, you’ve got to navigate both systems:
The U.S. (where baby is born)
Every U.S. state plays by its own rules when it comes to surrogacy. (Yes… EVERY STATE has its own rules…) Some are quick and smooth. Others take a bit more paperwork and patience. This affects how fast you get the birth certificate and other essentials – so having a legal pro who knows the ropes in the exact state your surrogate is delivering in? Non-negotiable.
Your Home Country (where baby will live)
This part usually includes things like:
- Establishing legal parentage
- Proving or applying for your baby’s citizenship
- Possibly a DNA test
- A whole lot of official-looking documents

2. Snag That Birth Certificate
This is your golden ticket. Nothing happens without it.
Heart to Hands will make sure the delivery hospital knows in advance that this is a surrogacy – that way, there’s no confusion when it comes to listing the right parent(s) on the birth certificate. But depending on the state, here’s what you might run into:
- Some states allow pre-birth orders (your names go straight on the certificate)
- Others require post-birth steps like a court hearing
- Sometimes the surrogate is initially listed on the birth certificate, and then the certificate gets amended later to remove her name
Your attorney will walk you through all of this and handle the tedious paperwork. You just focus on your new favorite human.
3. Passport Time
Once you’ve got your newborn’s birth certificate (check!) and parentage sorted (check!), it’s time to apply for your baby’s passport.
Your country’s embassy or consulate will give you the official to-do list, but here’s the usual:
- Birth certificate
- Legal parentage docs
- Your ID
- Possibly a DNA test – ask your attorney to help you arrange one that’s embassy-approved

- Check whether your country requires a visa or exit permit

- Be ready with all the usual suspects: proof of parentage, citizenship, and your legal relationship to the baby
